Mobile POS Will Surpass $2 Billion in 2013, iPad As Cash Register

When Apple Apple began using mobile devices in their stores, people in retail started paying attention. According to a recent study?from research firm IHL Group, 28 percent of North American retailers plan to adopt Mobile POS in some form by the end of 2013.?The Mobile POS market will surpass $2 Billion in hardware/software sales in North America this year.

Clarification: This data is not consumer point of sales transaction value, but sales of POS equipment hardware and software.

Overall, mobile in retail is now a $5.7 Billion business worldwide and continues to grow rapidly. It is the single fastest moving trend in retail since Internet was added to the stores, according to IHL Group.

The report summary also stated that more retailers, however, are not planning to install Mobile POS at all within the next 3 years (33 percent). ?Naturally, the adoption of a mobile POS solution is dependent on the type of retailer and volume of transactions, but I am drawing a blank for a retail environment that could not benefit from some mobility. But you do not have to be Apple to turn an iPad into a cash register in your business. The iPad on its own, with free or premium apps, can serve as a full-blown POS (point of sale) system for small and large businesses. If you have not been to a farmer?s market recently, take a look at all the merchants who can now take more than cash. Add a Square credit card reader or one from Intuit Intuit, and you are a mobile retail machine.

Years ago, I worked with a wireless software company that was building a mobile point of sale solution for wireless handhelds. They were ahead of their time ? having to use ruggedized handhelds from Symbol and Intermec Intermec and integrating with proprietary systems. But today, you can do all of that and more with an iPad. There are plenty of stories of how iPads and tablets, in general, are making their way beyond email or web surfing on the couch or using a tablet to show photos, but it is a serious profitability tool.

As a product reviewer, I see a lot of useless mobile stuff (to be candid) and I have seen no shortage of iPad stands, iPad cases, iPad accessories. Many are useful, some are definitely not. But I love this newest one on Kickstarter: MagBak, the World?s Thinnest iPad Mount. Elegant and brilliant are words that come to mind and it is already over-funded. I sure hope they make versions that will do the same for a variety of smartphones, too. Hint: I have an S3, S4, and Nexus 4 and would buy one of these? The reason I included this mount, however, is it makes for an even more functional point of sale system. Put up a magnet mount in your food truck, kiosk, or retail store and you have an impressive modern cash register.

The iPad can change your business processes. If there is not an app, you can get one custom built or build it yourself. The team at?Sweb Development?is working on custom apps, but also has a platform for building your own (on iOS or Android). Or look at the FileMaker platform that lets you custom develop your own, too. As most Forbes readers know, the iPad is not only a consumer device for fun gaming or watching videos; it is a robust business machine that can help you serve customers and get more work done out in the field or on the shop floor.

A&M Football Player Killed in New Mexico Accident

Texas A&M officials are confirming the death of redshirt freshman football player Polo Manukainiu.

According to A&M officials citing New Mexico State Police, five people were in an SUV Monday night travelling on US 550 north of the village of Cuba, which is northwest of Albuquerque. The vehicle went off the road shortly before 7:00 p.m. Mountain Time, overcorrected and rolled multiple times.

Manukainiu, a 19-year-old defensive lineman who was a passenger, was among the dead, along with his cousin, Utah freshman football player Gaius Vaenuku, and another cousin, Andrew Uhatafe. Manukainiu and Uhatafe were reportedly ejected in the crash. KSL-TV in Salt Lake City is reporting the family relationships of the three.

The vehicle's driver -- the only person believed by authorities to be wearing a seat belt -- and a fifth person in the vehicle were transported to a local hospital with what were described as minor injuries.

?We lost a terrific young man,? Texas A&M head football coach Kevin Sumlin said of Manukainiu in a statement Tuesday. ?Polo was loved by his teammates and coaches. Anyone who came in contact with him was struck by his sense of humor and smile. My heart aches for his mom and family members.?

Euless Trinity High School posted the following on their website:

"As we mourn the loss of three members of our Trinity family, we invite you to use this page as a place to share thoughts about Gaius Vaenuku (THS Class of 2013), Polo Manukainiu (THS Class of 2012), and Lolo Uhatafe (Euless Junior High student), along with support for Salesi Uhatafe (THS Class of 2013). All messages must be approved before they will appear, but we look forward to posting as many comments as possible."

Manukainiu sat out his first season as an Aggie but was expected to play in the coming season. He was a Euless Trinity High School graduate who helped lead the Trojans to an undefeated regular season as a senior.

According to his Aggie Athletics bio, he was rated a four-star prospect by ESPN and 247sports.com coming out of high school.

Manukainiu was a recreation, parks and tourism sciences major.

At 12:32 p.m. Monday, Polo sent his last message on Twitter noting he was about to travel.


This is the second Texas A&M football player to be killed in a car accident in the past two years. Joey Villavisencio, 22, died near Normangee on his way home in December 2011.

    Youth activists detained while trying to enter US

    NOGALES, Ariz. (AP) ? U.S. authorities have detained eight activists who asked to be allowed to re-enter the United States from Mexico on humanitarian grounds in a protest against American immigration policies.

    Customs and Border Protection officials detained the activists Monday after they filed applications for humanitarian parole at the Nogales border crossing to try to return to the United States.

    CBP officials said they could not comment on specific cases but under immigration law all applicants for admission bear the burden of proof to establish they are eligible to enter the country.

    Domenic Powell, a spokesman for the National Immigrant Youth Alliance, said the group hadn't been taken to a detention center as of Monday afternoon.

    He said the alliance would continue to pressure federal authorities to let the eight activists "go back home" to the U.S.

    Margo Cowan, a lawyer for the group, says she will file asylum applications on behalf of the activists if they are denied humanitarian parole.

    On the U.S. side of the border, about 60 people waiting for the activists chanted in Spanish, "No papers, no fear."

    Three activists left the U.S. and traveled to Mexico expressly to participate in the protest. The group wants to draw attention to the huge jump in deportations carried out under the Obama administration, and reaffirm their attachment to the country where they were raised.

    The first one to be detained was Claudia Amaro Escalera, 37, along with her U.S.-born son Yamil, 13. Amaro Escalera returned to Mexico six years ago after her husband was deported but lived more than 20 years in the U.S. and calls America home.

    Cowan said, "This will be a decision to be taken by the Obama administration, maybe not immediately, but I trust it will be the right decision."

    Humanitarian parole means the activists can be released with the understanding that they are not a menace to society, she explained.

    Lizbeth Mateo, Lulu Martinez and Marco Saavedra were the three youths who recently left the U.S. to organize the protest from Mexico with the National Immigrant Youth Alliance. They were brought to the U.S. illegally as children and have no legal status there even though they grew up in America.

    "We cannot ask others to do something we ourselves are not willing to do," Mateo said before getting to the border.

    She added the group hopes the Obama administration will create a process so all those who were deported from the U.S. can return.

    "We are giving President Obama a chance to do the right thing. They always say, 'Why don't you come here legally?' Well this is his chance to create the legal process."

    Members of NIYA such as Mateo have participated in other acts of civil disobedience, one of them in 2010 in the offices of U.S. Sen. John McCain, R-Ariz. They have also entered detention centers to publicize cases where prisoners are about to be deported without having a criminal record or a legal recourse.

    The activists have said that if they were detained, they would do the same in detention centers in Arizona.

    Maria Peniche and Adriana Gil Diaz could have benefited from a deferred action program recently offered by the Obama administration that lets young immigrants live in the U.S. on renewable two-year stays, but they had both returned to Mexico City shortly before the measure was announced.

    Peniche, who was raised in Boston, Mass., was hoping to continue her university studies in Mexico, because they were too expensive in the U.S.

    "I want to give a face and a voice to those who are undocumented immigrants like myself," she said.

    Luis Gustavo Leon, 20, said he has been deported from the U.S. four times. He had gone to Mexico two years ago to continue his university studies but did not get used to the lifestyle there. His parents and brothers are all in North Carolina.

    "I will keep trying because my family is there, because even though I'm Mexican, my culture is the American culture," he said.

    He added he was not afraid of being detained.

    "As long as there is hope, I will fight," Leon said. "If they tell me I can't do it, then I'll give up temporarily, but not completely. I'll go back to Mexico but later on I'll find a way to return."

    China reacts to India's new strike corps

    Beijing, July 21: China has reacted cautiously to India's proposal for the establishment of mountain strike corps along the Sino-Indian border.

    "The Chinese and Indian governments have signed several agreements on safeguarding peace and tranquillity in the border areas and on taking trust-building measures in the field of military," Chinese Foreign Ministry, said in written response to a query from PTI on China's reaction to the Indian move.

    "The overall situation in the border areas between the two countries is peaceful and stable. The Chinese side is ready to work with the Indian side to maintain peace and tranquillity on the border areas", the brief response said, without making any direct reference to the Indian government's clearance to form the division.

    Boosting the Indian Army's war fighting capabilities along the Line of Actual Control, government on Wednesday gave the go-ahead for the creation of a corps including deployment of 50,000 additional troops along the China border at a cost of around Rs. 65,000 crore.

    The move to form the Mountain Corps has not figured in the official media so far.

    The approval for the formation of the new corps comes as the two countries held advanced negotiations on the Border Defence Cooperation Agreement (BDCA) which figured prominently
    in Defence Minister A K Antony's visit here earlier this month.

    It was also discussed during National Security Advisor Shivshankar Menon's visit on June 28 when he held the 16th round of talks to resolve the border issue with his counterpart Yang Jiechi.

    Indian officials in Beijing earlier refuted perception that the BDCA which was proposed by China was aimed at containing the development of infrastructure on the Indian side of the border or freezing the troop levels.

    Germany Backs Away From EU Sanctions On Israel

    As you know, the EU recently took a step towards rebuilding the walls of its Jewish ghettos when the European Commission, which is the operative arm of the EU arbitrarily issued instructions forbidding EU member states from cooperating, transferring funds, giving scholarships or issuing research grants to public or private bodies in Judea and Samaria, eastern Jerusalem, and even the Golan Heights. In other words, the new Jewish ghetto according to the EU consists of Israel's indefensible 1948 ceasefire lines.

    I had a feeling at least some members of the EU might see this for what it is and react, and Germany, having been down this road before has been the first to disavow this ghettoization of Israel:

    In a statement issued by MP Philipp Missfedler, the Bundestag spokesman for German chancellor Angela Merkel?s Christian Democratic Union party and its coalition partner the Bavarian Christian Social Union, he stated the guidelines are ?pure ideology and symbolic politics? and will not contribute to finding a solution to the Israeli-Palestinian conflict.

    Missfelder stated it is encouraging that the Federal Government has moved away from the new EU directives, which declared that from January 1 2014, Israeli projects in the West Bank, the Gaza Strip, east Jerusalem and the Golan Heights will no longer be given European Union financial backing.

    ?Israel is the recognized administrative power in the territories without which approved development projects like solar energy or sewage works could not be installed," Missfelder stated.

    He continued that an implementation of the new EU guidelines could mean an ?end of research cooperation with the Hebrew University in Jerusalem because some of their academics have an address in East Jerusalem."

    Not to mention push back when it comes to German exports.

    This is symbolic of the conflict between Germany's mainstream parties and the far Left
    Greens, who are almost reflexively anti-Israel.

    It'a also worth mentioning that Germany recently concluded a deal with Israel for two more Dolphin subs...with Germany subsidizing part of the cost.

    Football Outsiders, The Minnesota Vikings, And Why The NFL Is Great

    If you've been reading the site for a while, you'll know that I have a great deal of admiration and respect for the folks that run the Football Outsiders website. They've been kind enough to sit down and do a Q&A session with us over the past couple of seasons (and they'll be doing one with us again next week), and their level of statistical analysis pretty much sets the bar for everyone else.

    The 2013 Football Outsiders Almanac is out, and it's something that you should pick up, in my opinion. As always, you'll find a ton of great analysis and projections for all of the teams in the National Football League, as well as the Minnesota Vikings.

    However, even with as great as the statistical analysis of the FOA is, the past couple of years have shown why the National Football League is the current king of American sports. Even with all the statistics and numbers and facts and everything else, there's just enough of an unpredictability factor in this sport to show that, in the end, we really don't know anything about anything when it comes to the NFL.

    I have the last three Football Outsiders Almanacs (or, more accurately, the electronic versions) here in front of me, and it shows a bit of a trend about the Minnesota Vikings. Each year, the FOA does a win projection based on a whole lot of numbers and statistics that I don't have access to, and really don't even want to begin to speculate on. All I know is that they have their methods. So, what have those methods shown for our favorite football team the past three seasons?

    Well, the 2011 Football Outsiders Almanac had a win projection for the Minnesota Vikings of 8.5 wins. . .essentially saying they could be a 9-7 football team that season. They were looking at a fairly weak schedule by FOA projections (29th in the NFL), and were thought to have the talent to squeak out a 9-7 campaign with Christian Ponder caddying for Donovan McNabb for a year before taking over the reigns himself.

    That certainly isn't how the 2011 season turned out for the Vikings, though. The McNabb signing turned out to be a worse disaster than asking Brett Favre to come back in 2010, the pass defense was one of the worst such units in the history of the National Football League (owing largely to the departure of Antoine Winfield, Chris Cook's legal issues, and pretty much no depth behind them), and the team limped to a 3-13 finish after Ponder was installed as the starter mid-season.

    That moves us to 2012, where the Vikings were going into the season with question marks everywhere. . .along the offensive line, at wide receiver, at quarterback, and on defense. Oh, and that Adrian Peterson fellow was coming off of a pretty nasty knee injury in the second-to-last game of the 2011 season and nobody was sure how his comeback was going to go.

    Despite the fact that many "experts" were predicting the 2012 Minnesota Vikings to be in play for the top overall pick in the 2013 NFL Draft, Football Outsiders projected the Vikings for 6.4 wins last season. . .a projection that appeared to be a pretty brave one at the time. Granted, they were facing the third-weakest schedule in the league by FOA's projections, but after they had been so bad the year before, that seemed like pretty high cotton. I'm pretty sure that I said that if the Vikings got all the bounces to go their way in 2012, they had a shot to be a .500 team.

    And we all know what happened last season. Adrian Peterson went absolutely nuts over the second half of the season, the defense stepped up when it needed to, and despite Christian Ponder's up-and-down season, the Vikings finished with a 10-6 record and got into the NFC playoffs on the final play of the regular season. Just like folks couldn't see the Vikings being as bad as they were in 2011, many couldn't see them being as good as they wound up being in 2012.

    Which brings us to 2013. I'll caveat the projected win number by saying that the 2013 FOA projects the Minnesota Vikings as having the second-toughest schedule in the league in 2013, as opposed to the "weak" schedules that they were projected to have in 2011 and 2012. Then again, the Vikings wound up the 2012 season having played one of the toughest schedules in the NFL as well. So, take that portion with as much salt as you'd like.

    However, despite Adrian Peterson being healthy going into the season (coming off of a year when he won both the Most Valuable Player and Offensive Player of the Year Awards), three first-round draft picks that one could reasonably argue were the best at their positions in the 2013 NFL Draft, another year in Coach Leslie Frazier's system, and the other positives this team appears to have going their way. . .the 2013 FOA has the Vikings projected for 5.5 wins.

    I may be misinterpreting, but I can't help but take that to mean the Football Outsiders folks mean that the Minnesota Vikings have somehow gotten worse from last July to this July. And you can call me biased, call me a homer, or call me a biased homer. . .but there's really no way I can see that as being the case. I just can't. Yes, I know that the Vikings lost Percy Harvin (who they didn't have for the last 7 1/2 games of the 2012 season anyway. . .5-2 record without him, if you're scoring at home) and Antoine Winfield, but there are a lot of positive changes on this squad, too.

    I guess that's why I'm not too dismayed over the projection. I don't think the 2013 Minnesota Vikings are (essentially) a 6-10 football team. I mean, they could be, I guess. . .just like I would have guessed that the 2011 Vikings could have gone 3-13 or the 2012 team could have gone 10-6. Personally, I think this team will, at the very least, be closer to the post-season than they will be to the top of the 2014 NFL Draft. Significantly closer, at that.

    University Of Florida Football Player Arrested For Barking At Police Dog

    GAINESVILLE, Fla. (CBS Tampa/AP) ? A University of Florida football player was arrested early Sunday morning for barking at a police dog.

    According to the Alachua County Sheriff?s Office, Morrison walked up to an open window on a police car and barked at a K-9 dog named Bear. The dog responded by barking back, prompting an officer to arrest Morrison for interfering with a police canine. According to the arresting officer, Morrison?s actions diverted the canine?s ?attention from my investigation and towards him.?

    Officers said the sophomore linebacker resisted attempts to handcuff him.

    Morrison told officers he made a ?woof-woof? sound at Bear because the dog barked at him.

    Morrison charged with resisting arrest and barking at a police dog and was booked into the Alachua County Jail. He was released on his own recognizance.

    This was the second time in the past month Morrison has been arrested. In June, the Gators linebacker was taken in after allegedly punching a bouncer at a bar. Morrison received a six-month deferral for the incident and will have that charge dropped after fulfilling the prosecution?s terms.

    Gators coach Will Muschamp announced Sunday that Morrison would be held out of the opener against Toledo (Aug. 31) and the road game the next week against Miami.

    Muschamp told the Orlando Sentinel last week that he was disappointed in Morrison?s offseason behavior.

    ?We have consequences if a guy makes a poor decision,? Muschamp said. ?When a young man makes a poor decision there?s a litany of things that I make them (do to) work themselves back.?

    Morrison was named to the Southeastern Conference Coaches? All-Freshman Team in 2012.

    England's ceremonial mayors eschew fur to support animal rights

    Animal fur may remain fashionable on catwalks, but lord mayors and other senior council figures in England have been happy to eschew haute couture by dropping its use or going faux.

    A check in the wardrobes of civic leaders has revealed eight do not have robes with fur, five use clothing with synthethic fur, and other authorities are reviewing their practice.

    The survey of 23 lord mayors was carried out by People for the Ethical Treatment of Animals (Peta), which is still awaiting answers from some, including Roger Gifford of London.

    Peta's associate director Mimi Bekhechi said: "It's important that public figures set a positive example, and by saying no to fur, these mayors have made it clear that animals deserve respect.

    "Animals raised for fur suffer every day of their lives before they endure a painful and terrifying death."

    The office of the lord mayor of Plymouth, Vivien Pengelly, said she had two sets of robes. "The black and gold robes, which are used for major civic or ceremonial events do not have any fur. The red robes are due to be refurbished and will be embellished with a fake fur band".

    Officials in York said: "We are in possession of a number of older ceremonial robes worn by the sheriff of York and honorary aldermen, which do have some very old fur trim. However, the sheriff's robe is due to go for refurbishment, and the fur trim will be replaced with a synthetic fur, as is our policy.

    "In addition, last year we acquired a new ceremonial cap of maintenance which is worn by our sword bearer ? This was a brand new commission and was made with synthetic fur. Any future purchases and refurbishment of old robes and ceremonial wear will continue in this way, as we support animal rights fully."

    In Hull, the lord mayor's red robe is trimmed only with gold braid, Peta was told, but six older red robes worn rarely by other senior council members were trimmed by fur. "We are unable to replace these at the present time as we have no funds available, but if and when we do, will certainly consider using faux fur," a council official said.

    The survey came after the mayor of Wrexham, David Bithell, neither a "lord" nor in England, abandoned his gown with muskrat after being questioned by a Peta supporter.

    Peta said most Britons opposed real fur. "So strong is our moral objection to cruelly killing animals for their skin that parliament passed an act banning fur-farming more than a decade ago. If council leaders wear fur-trimmed robes, it not only goes against British values but also diminishes the meaning of the ban."

    Some designers, such as Stella McCartney, Calvin Klein and Ralph Lauren, do not use fur but the British Fur Trade Association (BFTA) said 400 worldwide did. "Those who include fur, which is over 75% of all major fashion brands, do so because it enhances their business." Such designers were "more than satisfied" by the welfare standards of the industry.

    BFTA's members trade more than ?1bn worth of animal fur a year, including with China, Hong Kong, Russia and other EU countries, while UK retail fur sales have increased by 30% year on year. Global sales for 2011-2012 totalled US $15.6bn (?10.2bn), according to the International Fur Trade Federation.

    (AP) ? Lee Westwood has never been in better position to win his first major championship.

    The 40-year-old from England takes a two-stroke lead into the final round of the British Open at Muirfield, where the weather turned a bit Sunday. It's cloudy and cooler after a warm, sunny week along the Firth of Forth.

    But no rain is expected, and there's only a light breeze for the early starters. Jason Dufner took advantage of the conditions, shooting a 4-under 67. Six players have already had rounds in the 60s among the first 28 finishers.

    Westwood will tee off in the last group with a 3-under 210 total. Hunter Mahan and Tiger Woods are two shots back, the only other players under par. Masters champion Adam Scott is three shots back.

    Golfers Tee Off For The 17th Annual CMN Golf Classic In Hermon

    Hermon - Friday was a great day to hit the greens for a good cause.

    Golfers were at Hermon Meadow for the 17th Annual Children's Miracle Network Golf Classic.

    The event raises money for CMN.

    It's also a way to provide support to those battling illnesses, as well as family members.

    This was a favorite event for Joellyn Alexander's son, Sam, who lost his battle with cancer two years ago.

    "This was the second tournament he played in that last summer that we had him, and he had a really fun experience, and everybody at Children's Miracle Network is great anyway. Children's Miracle Network has supported us all the way through his treatments and still support us today," said Alexander.

    "What's really, really nice about this tournament is we have so many of the same golfers who come on out each and every year. They really look forward to this tournament each year," said Kelly Pearson, the director of EMHS Foundation Children's Miracle Network.

    The tradition continued this year with a putting and a chipping contest before the tournament.

    The rise of tablets has had a tremendous impact on us in a number of ways. Emerging markets have more widespread access to the Web thanks to low-cost tablets, a second screen trend is sweeping living rooms across major markets, the PC industry is in turmoil? but are tablets also making us smarter? A curious study commissioned by Next Issue Media and conducted by?Wakefield Research equates knowledge of news and current events with intelligence, and it found that those who own tablets like the iPad and Android devices believe they?re more in-the-know than others.

    The survey found that Americans want to be knowledgable when it comes to current events, and more than half of those polled by Wakefield like to be known as ?newsie.? When it comes to tablet owners, they seem to feel they have a clear advantage over their friends.

    ?A majority of Americans (56 percent) believed they were more knowledgeable about current events compared to their friends ? 65 percent of men and 48 percent of women felt this way,? Next Issue Media?said in a press release covering the study. ?Owning a tablet may be one way to boost your news-confidence. Sixty-nine percent of tablet owners felt they knew more about current events than their friends, compared to 47 percent of non-tablet owners.?

    Then, the study took a few odd turns. From the company?s release:

    • 53 percent of parents have cried when a celebrity died, versus 35 percent of adults who do not have children.
    • 42 percent of tablet owners have tried a fad diet because of something they?ve read, versus 19 percent of non-tablet owners.
    • 44 percent of people wish they had more time to indulge in learning more about food ? new recipes and diet tips.
    • 44 percent of women go to magazines for fashion inspiration while 37 percent go to their friends (same percentages for tablet owners regardless of sex).

    Wakefield Research polled 1,000 American adults via email in early May when conducting the study.

    Cellphone tracking: Police must obtain warrants, N.J. court says

    State courts and legislatures are grappling with the murky legal principles governing police surveillance and privacy. One point of concern: GPS-enabled smart phones can now reveal razor-sharp details about a person?s movements.

    Highlighting once again America?s struggle with government surveillance and personal privacy in the digital age, the New Jersey Supreme Court announced ?a new rule of law? on Thursday, forbidding police to obtain a suspect?s cellphone data without a warrant.

    The decision comes in the aftermath of Edward Snowden?s leak of government secrets that revealed massive government surveillance programs. Among other things, the programs allow law enforcement officials to collect ?metadata? from phone companies ? a practice that has just been reauthorized by a secret US court that oversees intelligence activities.

    The ruling also comes at a time when state courts and legislatures across the United States are grappling with the murky legal principles governing state laws about police surveillance and privacy. Breathtaking changes in technology mean that a GPS-enabled smart phone can now reveal razor-sharp details about a person?s movements, thus quickly changing traditional notions of privacy. Technological advancements have also made it easier for local police to obtain information from service providers.

    So the New Jersey court is one of the first to issue a full-throated ruling that a person?s location information is private and that police must obtain a full warrant based on probable cause before being able to obtain it.

    The ruling also makes this a ?right? to privacy, grounding it in the state?s constitution rather than in specific legislation.

    ?Litigants try to stay away from getting courts to make new law, because courts can be kind of reluctant to do so,? says Alex Chopin, a partner with Patton Boggs in Washington, D.C., and an expert in privacy law and social networking. ?So I thought it was very bold that New Jersey said, we are making a new rule of law here, and explicitly said, this expectation of privacy is legitimate and law enforcement needs to follow it.?

    In May, Montana Gov. Steve Bullock (D) signed the nation?s first bill that requires police to get court permission before tracking individuals with their GPS location information. And earlier this month, the legislature in Maine overrode the governor?s veto of a similar act that barred police from obtaining location information without a warrant.

    Texas Legislature Sidestep

    While Texas? 83rd Legislature might go down in state history as one of the most colorful, it didn't start out that way. Folks who normally view the biennial meeting as notice to break out the popcorn and grab a seat in the public gallery were initially disappointed. Affectionately known in Texas as ?the Lege?, the 140-day regular session was uncharacteristically bland. But the abortion debate closing the first special session focused the nation?s attention on the Lone Star State. Conservative Lege-watchers noted, however, that it was to the exclusion of other important legislation. In spite of statements by top Republican leaders and the all-but-certain pro-life victory at the end, sound legislation and fiscally responsible bills failed to get passed.

    More constitutionally-minded Texans hoped for more constitutional legislation ? and honest behavior ? from their legislators had Rep. David Simpson (R-Longview)?succeeded in his bid for House Speaker. Simpson gained national attention in his freshman year (2011) with his wildly popular anti-TSA bill, but when the Session convened January 8, he noted in a short withdrawal speech that his reason was the retaliation planned for his supporters if they voted for him.?

    In all, 10,630 pieces of legislation (House and Senate bills, and resolutions, which do not carry the weight of bills)?were introduced. But as the session progressed, conservatives and liberals alike were frustrated by the lack of action in even getting bills heard, especially conservatives who counted on Republican leaders. Bill Cherry of The John Birch Society had this observation about the Lege:

    ?We heard a number of pronouncements and public statements from top elected state officials about how much they were against ObamaCare and were not going to take part in the program. Yet, when at least five ObamaCare nullification bills (HB 3785?and HB 3709, ?et al) were introduced in both the House and Senate, not one made it through the process; they all died. They were stopped by the leadership making sure the bills never made committee or hearing deadlines, or they made sure there was no time left for bills to make it through the process to be voted on in the House and Senate."?

    At least one nullification bill introduced by Cecil Bell, a conservative freshman, was desperately drafted at the last minute when it became obvious that the others were meeting resistance, but to no avail. This prompted Cherry to add this observation about yet another freshman who got a similar surprise concerning his new role:

    I talked to a Legislator who told me he ran on a platform of limiting government?spending and taxes. He said, "I came here thinking I was representing the people in my district, but the leadership of the House made it clear to me that I was expected?to support the leadership?s agenda first if I wanted any chance of having one of my bills even considered."?

    Cherry continued, "The RINO House and Senate leadership in Texas takes full advantage of the lack of time, and confusion that takes place when over 5,000 pieces of legislation are introduced, like this session. Almost all the legislation dealing with limiting government, especially on the federal level, gets lost in the process and dies. But it?s amazing how fast an increased spending or tax bill can move through the process when it is a favorite of the leaders. Some of them move so fast that legislators don?t know where the bill stands in the process until it?s suddenly called up in the House or Senate for a vote.??

    As if made-to-order to support Cherry?s statement, consider what David Simpson had to say about the Lone Star State?s budget bill:?

    The legislature passed appropriations of $20.8 billion, an increase of 25 percent over the previous legislature!?A third of this was used to correct the smoke and mirrors used to "balance" the current biennial budget.?However, current spending was topped off with another $1.5 billion. So the estimated and budgeted spending for the current fiscal period is increasing $6.7 billion or eight percent over the previous period. And the budget for the 2014-15 biennium is set to increase?another $7.7 billion, or 8.7%.?

    Incredibly, as Simpson was testifying on the House floor opposing this budget, the Speaker called the issue to a close, preventing Simpson from having enough time to get back to his desk to even cast his vote.?

    Other legislation considered fiscally responsible and critical to liberty ? Second Amendment preservation, canceling all calls for a constitutional convention, banning smart meters, and the anti-TSA bill ? all floundered, even though they had popular support. And Texas? transportation policy continued to get hammered with 3P deals that sold out Texas roads to foreign companies. So much for the conservative posture adopted by Governor Perry, Speaker Joe Straus, and Lt. Governor David Dewhurst.?

    There were successes, though. It?s now well known that Texas abortion law has become stricter. Due to grass-roots pressure, a bill dealing with serious consequences for end-of-life decisions was also defeated. Simpson?s HB 78, eliminating sales tax on precious metals and coin purchases under $1,000 (purchases over $1,000 already exempt) was passed, even though his reintroduced anti-TSA bill hardly raised an eyebrow. And even though bills preventing a con-con (constitutional convention) failed, more legislators were educated and support grew for opposition. A con-con planned by the Compact for America never took place, possibly due to the education efforts of activists and capitol insiders.?

    Freshman legislator Giovanni Capriglione also introduced an important and forward-thinking bill to establish a gold depository in the state. Although popular, it eventually failed. Legislators asked for further study, so there?s hope for a future depository in Texas.?

    Barbara Harless, Founder of the North Texas Citizens Lobby, expressed Texans? disappointment with the failure to protect Second Amendment rights. ?The Lege failed to pass strong gun bills that support individual rights of self-defense and property defense. Instead, they increased the collection of non-criminal data (fingerprints) for CHL license holders. When permanent personal data that can?t be altered such as fingerprints, dental records, DNA, etc., is gathered for non-criminal reasons Texans need to be paying attention.? But then, the committee hearing most gun bills was chaired by an anti-gun Democrat ? appointed by Republican leaders.?

    Most days, your reporter could be found monitoring, reporting, or lobbying legislators, and observing the displeasure of many Texans with the Lege. One wonk was heard to say, ?This is Texas! We have a reputation of independence to uphold, but these guys are cowing to the federal government!? The speaker was referencing conversations in which lawmakers and staffers were heard to state that ObamaCare was now law because ?the Supreme Court said so.? But many were heartened to see the efforts of the freshmen?who are considerably more liberty-minded than their predecessors. Steve Toth, Scott Turner, Scott Sanford, Cecil Bell, Giovanni Capriglione, and Jonathan Stickland, among others, have proven to be principled, and might well turn the tide in Texas politics if they return to office. But perhaps Scott Turner said it best. Near the end of the session, a highly-intelligent group of conservative homeschoolers from Collin County snagged a few minutes with Turner on the Capitol steps and asked what they could do to help. Voicing the thoughts of every other conservative in the building, Turner replied, ?Hurry up!?

    Upscale tile and plumbing company Ann Sacks will open a new retail store in Seattle's South Lake Union neighborhood later this summer.

    Vulcan Real Estate said the 2,900-square-foot store will open across from the Whole Foods grocery store next to the new West Elm store at 2201 Westlake Ave.

    Portland, Ore.-based Ann Sacks has 16 locations, including one in downtown Seattle at 115 Stewart Ave.

    UnitedHealth second-quarter profit rises, beats expectations

    (Reuters) - UnitedHealth Group Inc on Thursday reported a bigger-than-expected rise in second-quarter net income as it enrolled more people in private and government-paid health insurance plans and sold more health technology systems.

    UnitedHealth reported net income of $1.44 billion, or $1.40 per share, compared with $1.34 billion, or $1.27 per share, a year earlier.

    Analysts on average had expected earnings of $1.25 per share, according to Thomson Reuters I/B/E/S.

    Revenue rose to $30.4 billion. Analysts had expected $30.5 billion.

    The quarterly results come as the company, the largest U.S. health insurer and the first to report earnings for the period, prepares for more changes stemming from President Barack Obama's healthcare law, the Affordable Care Act.

    Next year, the government will expand the Medicaid program for the poor in many states, and state-based health exchanges will start selling subsidized insurance to individuals. About 7 million people are expected to sign up for insurance next year.

    UnitedHealth raised the low end of its 2013 outlook by 10 cents a share to $5.35 while keeping the high end at $5.50. Analysts had forecast $5.44.

    While this quarter was strong, the forecast likely reflects pressure on profitability in insurance plans like private Medicare that are paid for by the government, which is cutting how much its pays for healthcare services, one analyst said.

    "Changes in margin mix in the business, likely the (Medicare Advantage) and TriCare (military) segments, suggest that margin pressures still abound," CRT Capital analyst Sheryl Skolnick said in a research note.

    UnitedHealth said the number of people enrolled in its insurance plans, including through small businesses, large corporations, the military, Medicare for the elderly, and Medicaid, was 89.2 million at the end of June, up from 86 million at the end of March.

    The company said it had spent 81.5 percent of its premiums on medical claims during the quarter, an increase of 20 basis points from a year earlier.

    The health reform law, known as Obamacare, sets targets for this ratio. It has also required many insurance plans to include more free preventative services.

    Even so, insurers have benefited from Americans' reduced use of medical services over the past several years, a trend Skolnick said appeared to have continued this quarter.

    Operating earnings were flat in the company's insurance business and increased in the Optum health technology unit, the UnitedHealth said.

    Lawyer: Brooklyn Nets coach Kidd to plead guilty

    HAMPTON BAYS, N.Y. (AP) - Brooklyn Nets coach Jason Kidd intends to plead guilty to a drunken driving charge, his lawyer said Tuesday.

    Kidd is expected to receive a suspended sentence, attorney Edward Burke Jr. told The Associated Press ahead of Kidd's court appearance on Long Island. He also will speak to high school students about the dangers of drunken driving.

    Prosecutors did not immediately comment.

    Kidd, who retired as an NBA player after last season, was recently hired to coach the Nets, the team he took to two NBA Finals as a player when the franchise played in New Jersey.

    Police said Kidd crashed his SUV into a telephone pole in the Hamptons community of Water Mill on July 15, 2012. He was treated at a hospital for minor injuries.

    Burke said Kidd was returning from a charity function before the crash. A Southampton Town Police report noted the 10-time all-star and Olympic gold medalist was unsteady on his feet, smelled of alcohol and had bloodshot and glassy eyes.

    While playing with Phoenix in 2001, Kidd was arrested on a domestic violence charge, acknowledging he struck his former wife.

    Following the significant price cut Microsoft's Surface RT received in the US recently, its cost has begun dropping in other regions, too. In the UK, Redmond's official online store is selling the 32GB model for £279 (down from £399) and the tablet with 64GB of storage for £359 (reduced from £479) -- adding £80 to those prices will get you the Touch Cover bundle. UK retailers John Lewis and PC World are offering the same discounts (although the latter is £0.99 more expensive across the board), and Microsoft's Australian store is knocking up to 180 Aussie dollars off the tablets and cover bundles. We imagine all countries the RT ships to will follow suit if they haven't already, so check your local MS store for confirmation. Meanwhile, it's hard to escape the feeling that RT as a whole has been overtaken by events.
