Crafting with Kids: A Birthday Crown : Ideas for Women Home and ...


All kids want something special on their birthdays. You can make the day special by allowing them to make a birthday crown just for them to wear. It is an easy craft and kids will love it.

What You Need:

  • Construction paper
  • Scissors
  • Transparent tape
  • Marker
  • Glue
  • Glitter
  • Stickers

How to Make:

  1. Choose two pieces of construction paper. Cut one of the pieces of paper into 2-inch wide strips. Line the strips end-to-end making one long band. Attach the pieces to one another using transparent tape.
  2. Wrap the band around the child?s head so it covers his or her forehead. Mark about 2 inches beyond where the ends of the band overlap at the back of the child?s head. Cut off any excess paper beyond the mark.
  3. Lay the band out flat on a table and decorate it.Trace six 2-inch squares on the second piece of paper. Add triangles to the top of each square to make shapes that resemble small?houses?and cut out the shapes. Tape the bottom of each shape to the inside edge of the headband so most of the squares stick out the top of the crown.
  4. Decorate the crown by writing the child?s name on the center of the band using glue. Sprinkle glitter over the glue to make the name shimmer and shake off the excess glitter. Add stickers to the crown or draw on smiley faces using markers. Let the glue dry completely.Tape the ends of the band together.
  5. Use two or three long pieces of tape to ensure that the crown stays together all day.

Letter writing has a history that goes back thousands of years. A few surviving letters suggest it was common practice to write letters to the dead in ancient Egypt. Soroptimist International of Parker is presenting their 32nd annual ?Kids and Christmas? program Saturday, Dec. 1. The event features the fifth annual ?Parade of Lights,? which starts at 6 p.m. The parade will follow Joshua Avenue, starting from 18th Street. The parade will end at the Parker Community/Senior Center at 12th Street and Laguna Avenue. Parade entry forms can be picked up at the Parker Area Chamber of Commerce.

Santa Claus will be on hand at the senior center immediately after the parade to meet with local children. Youngsters can have their picture taken with Santa.

DOYLESTOWN, Pa. (CBS) ? A four-wheeler with a plow attached helped to remove snow off the sidewalks in Doylestown, Pennsylvania.

While some people have welcomed fall with a smile, accepting winter with open arms may not be as easy.

?This is what we have to look forward to the next couple months,? said one woman.

At Nonno?s coffee shop, customers are cozy, ordering hot drinks, watching the snow fall from inside.

?It?s nice watching traffic and relaxing,? said Bill Dunn of Doylestown.

For the people, children imparticular, who love this type of weather, playing in the snow never gets old. Five-year-old Mackenzie Maroney of Seattle,Washington built a snowman at her grandfather?s house and begged him to take her?sledding?while she?s in town.

Kenya's Safaricom revamps mobile phone banking with CBA

NAIROBI (Reuters) - Kenya's top telecoms operator, Safaricom, will offer a new mobile phone-based banking product with Commercial Bank of Africa (CBA) to tap into an underdeveloped market for financial services.

The firm, which is 40 percent owned by Britain's Vodafone, has been looking to build on the success of its phone-based money transfer service, M-Pesa.

Started in 2007 as the world's first mobile-phone based service for moving money around, M-Pesa has grown to account for a sixth of Safaricom's revenue or 10.43 billion shillings in the firm's first-half ended September .

It has also given the east African nation of 40 million people a reputation as a pioneer in financial innovation.

Known as M-Shwari, the new service will allow Safaricom's subscribers to save money and access short-term credit from CBA.

Although the country has seen an increase in the population's access to financial services in recent years, about a third of the population still lacks access, the central bank says.

Total deposit accounts in the financial sector leapt to 15 million at the end of September this year from 2.5 million in 2005, the central bank said, but many poor people especially in rural areas still keep their cash in mattresses at home.

"Research indicates that a staggering 200 billion shillings remains unbanked, not earning interest and not generating much value to their owners," said Bob Collymore, Safaricom's chief executive.

He said that M-Shwari "will foster a culture of saving."

Unlike a previous attempt to offer a similar service with Equity Bank, users of M-Shwari will not be required to directly open a bank account with CBA.

Known as M-Kesho, the previous service required users to also open an account with Equity Bank, to access banking services on their mobile phones.

M-Shwari users will save money at an annualised deposit interest rate of up to 5 percent and allows them to borrow amounts of up to 20,000 shillings for up to 30 days at a one-time interest rate of 7.5 percent, both firms said.

"With this mobile banking product we will leverage on Safaricom's customer base of over 19.2 million subscribers - 15 million of whom are already on M-Pesa," said Isaac Awuondo, CBA's managing director.

Let the fiscal cliff road show begin

President Barack Obama and Republican House Speaker John Boehner meet at the White House on November 16 to discuss??President Barack Obama is ramping up efforts to win over Americans ? and pressure Congress ? on the looming fiscal cliff, with events at the White House and on the road to argue for the expiration of Bush-era tax cuts chiefly benefiting the rich.

The response from his top Republican foes? On Tuesday morning, Republican Senate Minority Leader Mitch McConnell portrayed the president's outreach effort as an unserious distraction from negotiations with Congress. But minutes after McConnell's sharp-tongued criticism, Republican House Speaker John Boehner's office announced that his members would be countering the president's road-show with one of their own.

Obama was meeting Tuesday behind closed doors with 15 small-business owners from the retail, construction, and health care information technology sector. ?At the White House on Wednesday, the president planned to showcase Americans who would be affected if no deal can be reached to extend middle-class tax cuts. On Friday, Obama planned to travel to the Philadelphia suburb of Hatfield to make a speech at the Rodon Group manufacturing facility. Rodon is an American maker of K'NEX Brands, which include Tinkertoy, K'NEX, and Angry Bird Building Sets.

In a speech on the Senate floor, McConnell cast the White House efforts as little more than a public relations gambit.

"Rather than sitting down with lawmakers of both parties and working out an agreement, he's back out on the campaign trail, presumably with the same old talking points we're all familiar with," McConnell said. "Look: we already know the President is a very good campaigner. What we don't know is whether he has the leadership qualities necessary to lead his party to a bipartisan agreement on a big issue likes this."

But 26 minutes after a transcript of McConnell's remarks landed in reporters' in-boxes, Boehner's office made it clear that the House GOP would also be taking its sales pitch on the road.

Republican lawmakers planned to hold events with small businesses around the country warning that job creation will slow if taxes on small businesses are hiked, aides said.

Republicans have warned that Obama's push to let tax cuts expire on income over $200,000 for individuals and $250,000 for families will hit some small businesses, a sector they often credit with fueling job growth. The president characterizes the tax increase -- a centerpiece of his successful reelection campaign -- as asking wealthier Americans to pay more in order to preserve popular government programs that might otherwise face steep cuts.

"Republicans understand that we must avert the fiscal cliff and have laid out a framework to do so that is consistent with the 'balanced' approach the President says he wants," Boehners spokesman Brendan Buck said. Buck accused some Democrats of ruling out "sensible spending cuts," notably overhauls of popular entitlement programs like Medicare, the government health care plan for seniors, and Medicaid, a state-federal program that provides health care to low income Americans.

The White House and Congressional Republicans profess eagerness to avoid the fiscal cliff, an economically toxic blend of tax increases and dramatic spending cuts that will go into effect January 1 unless at deal is reached on a far-reaching deficit-cutting plan (or an agreement is reached to push back what are Congressionally enacted deadlines that lawmakers can un-enact if the president signs on).

Obama spoke to Boehner and Democratic Senate Majority Leader Harry Reid over the Thanksgiving weekend, but Republicans have complained that negotiations are at an impasse. One of the major roadblocks is the fight over whether to let tax rates on higher incomes revert to Clinton-era levels. The fiscal cliff fight could shape the direction of the nation's spending for a decade ? and it certainly amounts to Obama's first major test of post-election clout.

OECD urges gradual U.S. fiscal tightening to preserve growth

WASHINGTON (Reuters) - Tighter fiscal policy in the United States should be implemented gradually, the Organization for Economic Cooperation and Development said on Tuesday as it predicted moderate economic growth next year.

Automatic government spending cuts and tax increases, known as the "fiscal cliff", are set to begin in early 2013, draining about $600 billion from the economy unless the U.S. Congress and Obama administration agree on a plan to soften the blow.

In its latest economic outlook, the OECD said while cutting the large budget deficit was necessary to put the nation on a sustainable fiscal path, this should be done gradually and in the context of a well identified medium-term consolidation plan.

"The pace of consolidation should be gradual so as not to derail the already weak recovery," the OECD said. "If unresolved, the fiscal cliff would generate a significant drop in activity in 2013."

The United States has run budget deficits topping $1 trillion for three straight years, and it is on course to do so for a fourth.

The Paris-based OECD forecast growth in the world's largest economy averaging 2.2 percent in 2013, up from a projected 1.8 percent this year. Output is seen expanding at an average of 3.2 percent next year.

Annual gross domestic product expanded by an average of 2.1 percent over the last two years. The OECD forecasts assume the reduction in the U.S. budget deficit is limited to 1.5 percent of GDP in both 2013 and 2014.

But it said economic headwinds will continue to blow from the debt crisis in Europe and slowing global demand.

"The potential credit market disruptions associated with the ongoing crisis in the euro area remain a major concern," the OECD said. "Growth in disposable income will continue to be restrained significantly by the withdrawal of fiscal support."

OUTPUT GAP TO NARROW

But with U.S. economic growth expected to accelerate next year, the output gap -- the difference between the actual output and output at full capacity -- should narrow to 2.5 percent by the end of that year, the OECD predicted.

The output gap is currently 5.9 percent. Underpinning growth this year and in 2014 will be increased household spending, reflecting a turnaround in the housing market, which until recently was the economy's Achilles heel.

"Household balance sheets continue to improve, with equity values recently returning to near cyclical highs and home prices showing a sharp and sustained upturn," the OECD said.

"The gains in net wealth, coupled with low interest rates and a continued easing in lending conditions, should contribute to a pick-up in aggregate demand going forward."

It forecast a gradual improvement in the labor market and projected the unemployment rate falling to 7.5 percent over the course of 2014 from a projected 7.8 percent average in 2013.

The jobless rate was at 7.9 percent in October and almost all the decline from a peak of 10 percent in October 2009 was because of frustrated people giving up the search for work.

Given the still considerable slack in the economy, inflation pressures are likely to remain contained, even though wages could see rapid growth as the labor market improves, the OECD said.

This should help the Federal Reserve to honor its pledge to keep interest rates near record low levels through at least mid-2015.

The OECD forecast the consumer price index rising 1.8 percent over the course of next year and picking up to 2 percent over 2014.

The U.S. central bank, which has held overnight lending rates near zero since December 2008 and pumped about $2.3 trillion into the economy through bond purchases, aims for a 2 percent inflation rate.

"With significant slack in resource utilization and inflation expectations appearing well anchored, this highly accommodative stance of monetary policy is warranted," the OECD said.

CHICAGO - Jay Cutler returned from a concussion to lead Chicago to a win, while the Bears now have to deal with injuries to Devin Hester and a slew of teammates.

Cutler threw for 188 yards and a touchdown after sitting out a game because of a concussion, and the Bears broke it open early for a 28-10 victory over the Minnesota Vikings on Sunday in a game that saw Hester, Matt Forte, Charles Tillman and both starting guards sidelined.

Tied with Green Bay for the NFC North lead and just a game ahead of Minnesota (6-5) coming in, the Bears (8-3) grabbed a 25-3 halftime lead with Cutler connecting on just about every pass. The defense held Adrian Peterson in check early on, although he finished with 108 yards rushing.

Chicago also came away with three more takeaways to increase its league-leading total to 30.

The rather easy win came after back-to-back losses to Houston and San Francisco, but came with a heavy price.

Hester was lost early on to a concussion; Forte hobbled off midway through the third quarter with an ankle injury, and coach Lovie Smith said Tillman hurt his ankle.

Guards Lance Louis and Chris Spencer went out with knee injuries in the third quarter, with Louis' injury forcing Chicago to go with Gabe Carimi - who lost the right tackle job to Jonathan Scott.

As for Cutler, he looked sharp after missing Monday's blowout loss at San Francisco.

Back after being knocked out of the Texans game on a helmet-to-helmet hit by Tim Dobbins, he got off to a scorching start and completed 23 of 31 passes with an interception to go with the touchdown.

Brandon Marshall caught 12 passes for 92 yards and became the first Bears receiver since Marty Booker in 2002 to go over 1,000 yards. On defense, Henry Melton set the tone by sacking Christian Ponder on the first play from scrimmage. Nick Roach set up the first touchdown by knocking the ball out of Peterson's hands. Chris Conte set another TD with a 35-yard interception return, and Julius Peppers blocked a field goal.

The league's leading rusher, Peterson tied Robert Smith's club record with a 100-yard performance for the fifth straight game even though he managed just 25 in the first half. He also lost two fumbles.

Ponder wasn't much help, going 22 of 43 with 159 yards and a touchdown along with an interception. His favorite target, Percy Harvin, sat out his second straight game with a sprained left ankle, and the Vikings lost for the third time in four games.

Cutler completed 15 of 17 passes for 117 yards in the first half, and the Bears jumped out a big lead after a shaky start on offense.

Forte fumbled on Chicago's first play from scrimmage, leading to a 40-yard field goal by Blair Walsh - all the scoring the Vikings did in the half.

The Bears quickly turned this one around, starting with Roach's forced fumble. They took over on the Minnesota 34, and Michael Bush ran it in from the 1.

Chris Kluwe then shanked a 22-yard punt, giving Chicago possession near midfield before Robbie Gould kicked a 47-yard field goal. And the Bears stopped the Vikings again early in the second quarter when Peppers knocked down Walsh's 30-yard field goal, the 13th block of his career.

Bush, in for Forte, converted on a fourth-down run to keep a drive going and Antoine Winfield shoved Brandon Marshall to the ground as he attempted to catch a pass in the end zone. Bush then scored from the 1, and holder Adam Podlesh ran in for a 2-point conversion that made it 18-3.

Ponder got picked off by Conte and he returned it 35 yards to the Minnesota 13. That led to a scoring strike from Cutler to a lunging Matt Spaeth on the next play. It might have been more had Kevin Williams not blocked Gould's 39-yard field goal as the half expired.

Atlanta (AP) ? The Centers for Disease Control and Prevention says black women are 40 percent more likely to die of breast?cancer than white women are.

Breast?cancer is the second leading cause of cancer deaths among American women, but the CDC?s Ileana Arias says black women have ?unacceptably high? death rates. She says they have the ?highest death rates from breast?cancer among all racial and ethnic groups.?

Arias says many lives could be saved each year with proper screening and treatment, stressing the importance of educating black women to coverage provided by the new health care law, including mammograms without co-pays in many health plans.

JFK's last night recalled as key event for Latinos

President John F. Kennedy was supposed to just stop by and wave hello.

Instead a group of eager Latinos persuaded him to come inside and speak to a packed room of Mexican-American civil rights activists. And then he persuaded his wife, first lady Jacqueline Kennedy, to address the crowd in Spanish.

It was Nov. 21, 1963. Hours later, the president was dead, his assassination overshadowing the significance of a speech that can be seen as the birth of the Latino vote, so instrumental in 2012 in helping re-elect the first black president, Barack Obama.

To historians, Kennedy's appearance at the Rice Ballroom in Houston was likely the first time that a president officially acknowledged Latinos as an important voting bloc.

Though there are no plaques marking the historic occasion, the event is a touchstone for activists even if the spot where Kennedy sat and heard a band play Mexican ballads and where the crowd yelled "Viva Kennedy!" is now a refurbished ballroom in a loft apartment complex that often plays host to weddings.

"That evening ... that's where it began," said Ignacio Garcia, author of "Viva Kennedy: Mexican Americans in Search of Camelot" and a history professor at Brigham Young University. "But because very few people know about the meeting, it's like it never happened."

The surprise visit came after Mexican-Americans in Texas, New Mexico, California, Arizona, Illinois and Indiana helped Kennedy win critical swing states in 1960, thanks to an unprecedented voter registration drive in Latino communities. Independent "Viva Kennedy!" clubs sprang up. Sen. Dennis Chavez, D-N.M., and Texas legislator Henry B. Gonzalez of San Antonio, a future congressman, began speaking in Hispanic neighborhoods across the country and positioned themselves as the first recognizable national Latino political figures.

Just as in 2012, Republicans in 1960 did little to woo Latinos to support their presidential candidate, Richard Nixon. Latinos also identified with Kennedy, who was Catholic and Irish-American, a member of an ethnic group that had battled discrimination similar to what Latinos faced in the segregated Southwest.

On Election Day in 1960, Kennedy won 85 percent of the Mexican-American vote.

But during Kennedy's first months in office, Latino leaders expressed dismay that the president had failed to appoint Hispanics in his administration. Chavez even openly criticized Kennedy for his lack of appointments; other leaders embarked on a letter-writing campaign over the slow movement on civil rights.

Sensing another close election in 1964 and hoping to ease tensions, Kennedy visited Texas in November 1963. Advisers suggested that he at least pay a quick visit to Mexican-American activists at a Houston gala sponsored by the League of United Latin American Citizens, then the largest Latino civil rights group in the country.

"The Secret Service told us that he may stop by, but not to advertise it because it wasn't part of his official schedule," said Alexander Arroyos, 76, who was an officer in LULAC at the time. "We could spread it through word of mouth. No one believed us."

Then Kennedy showed up.

The president was greeted at the door by Macario Garcia, who was awarded the Medal of Honor for his service during World War II. Inside the ballroom, Kennedy and the first lady found an enthusiastic crowd of World War II veterans, civil rights advocates and future elected officials.

Kennedy spoke briefly about foreign policy in Latin America and the importance of LULAC. The first lady told the crowd in Spanish that Texas had a deep history with Latinos. The crowd responded with chants of "Viva Kennedy!" A band played a ballad in Spanish as photographers took photos of the Kennedys and Vice President Lyndon B. Johnson and his wife, Lady Bird Johnson.

Before that moment, historians believe that no president had ever acknowledged Latinos as a voting bloc, said Emilio Zamora, a historian at the University of Texas at Austin.

President William Taft, who served from 1909-1913, may have met with a tiny group of Latino activists in El Paso, Texas, Zamora said. President Dwight D. Eisenhower likely shock hands with some Mexican-American voters in a campaign visit to South Texas in 1952. "But I think no president had ever publically thanked Mexican-Americans in that manner," said Zamora.

Fifteen hours after the historic meeting, Kennedy was dead.

Band members who had played for the president the night before wept as the news unfolded. When Arroyos heard about the assassination, he told his boss at an import company he was too upset to work. Arroyos rushed to collect from friends as many photos as possible of Kennedy's visit at the Rice Hotel as he could for a future edition of a LULAC newspaper.

On Election Day 2012, analysts routinely spoke of Latinos finally awakening as a "sleeping giant" by giving Obama around 70 percent of their vote. But Ignacio Garcia said that assessment ignores how Latinos have influenced presidential elections for more than 50 years.

In 1960, for example, their overwhelming backing helped put Texas and New Mexico in Kennedy's column during the tight race against Nixon. The Republican's campaign did not have a presence in Mexican-American neighborhoods and did not have a Spanish language TV ad, unlike Kennedy, who tapped the first lady for it. Kennedy also made promises to appoint Mexican-Americans to his administration.

Johnson enjoyed support from Hispanics who campaigned for him during his landslide victory in 1964, and Mexican-Americans came out strongly for Sen. Robert F. Kennedy, D-N.Y., during the 1968 Democratic primary in California.

In 2000, then-Texas. Gov. George W. Bush, a Republican, was able to edge Democrat Al Gore, thanks in party to receiving about 40 percent of the Latino vote, according to various estimates.

"The Latino vote did not come of age the night Obama was re-elected," said Garcia. "It came of age Nov. 21, 1963."

The reason the Latino vote is attracting attention in 2012 is that Latinos are now the largest minority group in the U.S. and voter participating rates are up, Garcia said.

Voter participation for eligible Latino voters has gone from 3.7 million in 1988 to an estimated 12.5 million in 2012, according to the Pew Hispanic Center. That number could to double within two decades, the center said.

Arroyos said most of the older activists shrug off the pronouncements that Hispanics are finally influencing national elections even though his generation helped give birth to the Latino vote. Still, he said even those who are still alive and remember that Kennedy speech probably don't even know what role they played that eventually led to the voting numbers in 2012.

"I didn't know that evening was so historic," said Arroyos. "I was just happy that he dropped by and just didn't say hi."

New Rules Defined for ?Results Based? Wellness Programs | E is for ...

Proposed regulations issued by the IRS, DOL and HHS (the ?Agencies?) on November 20, 2012 increase, for plan years beginning on or after January 1, 2014, the maximum permitted reward that ?health-contingent wellness programs? (i.e., ?results-based? programs) may offer, from 20% of the total health insurance premium applicable to individual coverage, to 30%, with an additional 20% incentive permitted only in connection with programs to reduce or eliminate tobacco use.? The proposed regulations, which amend final regulations from 2006 on HIPAA?s nondiscrimination provisions, make other changes to the five ?consumer-protection conditions? that such programs must satisfy.[1]? Below, I highlight key changes under the new regulations:

Financial Incentives

  • As mentioned, the maximum financial incentive that a results-based wellness program may offer in 2014 is an amount equal to 30% of the total premium cost (employer and employee portions) for individual coverage under a group health insurance policy or self-funded plan.? (The percentage may be based on family or self plus one coverage costs only to the extent that the added spouse/dependents may participate in the results-based wellness program.)
  • An additional 20% incentive is allowed (for a total incentive of 50%) but only if it is offered in connection with a program that reduces or stops tobacco use.?
  • Employers must be sure that their results-based wellness program incentives do not exceed the 30% and 50% thresholds either separately or when added together.?
    • An example in the regulations describes a wellness program that offers an annual premium rebate of $600 to employees who attain goals under a program for reducing weight, blood sugar and other biometric measurements, and also imposes an annual $2,000 surcharge on employees who have used tobacco in the last 12 months and who are not enrolled in the plan?s tobacco cessation program.? The annual individual premium under the related group health plan is $6,000, of which the employer pays $4,500.? This program design meets the maximum incentive thresholds because the total of all rewards (including not imposing the tobacco use surcharge) is $2,600 ($600 + $2,000) which does not exceed 50% of the total cost of individual coverage, which is $3,000 ($6,000/2).? Also, tested separately, the $600 reward for the non-tobacco wellness program does not exceed 30% of the total annual cost of individual coverage, which is $1,800) ($6,000 x 30%).
    • The regulations make clear that rewards for participation-only wellness program components do not need to be factored in to the maximum reward calculation, even if the participation-only component (such as completion of a health risk assessment) is teamed with a results-based component (such as required smoking cessation).
    • The regulations reassert that permitted financial rewards may take the form of a premium rebate or contribution, a waiver of all or part of a cost-sharing mechanism (such as deductibles, co-insurance, or co-payments), the absence of a surcharge, the value of a benefit that would not otherwise be provided under the plan, or other financial or nonfinancial incentives or disincentives.
      • Compliance Note:? All wellness programs must be ?voluntary? in order to meet the requirements of the Americans with Disabilities Act.? The Equal Employment Opportunity Commission (EEOC), which administers the ADA, has not clearly defined what makes a wellness program ?voluntary? or not voluntary.? This remains a compliance grey area for employers.
    • The new rules apply to non-grandfathered and grandfathered plans under the Affordable Care Act (ACA), and to insured and self-funded group health plans, whether ?small? or ?large? plans.? They do not yet apply to individual insurance policies.? The uniformity is intended to make it easier to implement the tobacco use surcharge (up to 50% of the applicable premium) which is set forth in proposed regulations on guaranteed availability and premium rating?that HSS issued on the same day as the wellness regulations.[2]?? (The HHS regulations cover other insurance market reform provisions under the ACA and will be the topic of a future post at www.EforERISA.com.)

Offers of Reasonable Alternative Standards

The regulations provide substantial new information on how employers and insurers may comply with the requirement of offering a ?reasonable alternative standard? ? or waiver of the otherwise applicable standard ? to employees who cannot attain the results-based goals due to medical reasons.? (The specific criteria are that the goal either is ?unreasonably difficult? to attain ?due to a medical condition,? or that it is ?medically inadvisable? for the employee to attempt to reach the goal.)? References below to ?employers? apply equally to group insurance carriers where applicable.

  • First, the regulations provide two examples of new model language notifying employees of the reasonable alternative standard concept.? The new language replaces the prior, more opaque notice, which may have a chilling effect on some employees.? The standard model language, and a permitted variation, both are repeated below:

??Your health plan is committed to helping you achieve your best status.? Rewards for participating in a wellness program are available to all employees.? If you think you might be unable to meet a standard for a reward under this wellness program, you might qualify for an opportunity to earn the same reward by different means.? Contact us at [insert contact information] and we will work with you to find a wellness program with the same reward that is right for you in light of your health status.?

?Fitness is Easy! Start Walking!? Your health plan cares about your health.? If you are overweight, our Start Walking program will help you lose weight and feel better.? We will help you enroll. (**If your doctor says that walking isn?t right for you, that?s okay too.? We will develop a wellness program that is.)?

  • The notice of a reasonable alternative standard must be set forth in all written materials that describe the wellness program but does not need to be added to materials that simply make reference to the existence of the program.? For instance, it need not be set forth in the Summary of Benefits and Coverage document (which is provided by carriers to employers with insured plans).
  • Employers do not need to ?pre-design? reasonable alternative standards but instead may design them once an employee requests alternative standards.? As provided in the 2006 regulations, however, employers may design alternative standards for specific sub-populations, such as cholesterol reduction programs tailored to employees whose high cholesterol readings make it unreasonably difficult or medically inadvisable for them to attempt to attain lowered readings.
  • If the reasonable alternative standard is completion of an educational program, the employer must make the educational program available, instead of requiring the employee to locate one, and may not require the employee to pay for the program.
  • If the reasonable alternative standard is a diet program, the employer does not need to pay for the cost of food but must pay any membership or participation fee.
  • If the reasonable alternative standard is compliance with the recommendations of a medical professional, and the medical professional is hired or employed by the employer, the employer must offer a reasonable alternative standard if the employee?s own physician determines that recommendations made by the employer?s physician are not medically advisable for that employee.? Regular insurance co-pays or costs will apply to medical items and services furnished in accordance with the physician?s recommendations.
  • The new regulations provide that, only where it is ?reasonable under the circumstances,? employers may request a written statement from an employee?s personal physician that the standard wellness goal presents unreasonable difficulties to the employee or that it is medically inadvisable for the employee to attempt to attain it.? When the medical problem or health status that is at issue is clearly apparent, for instance confinement to a wheelchair, the employer does not have a reasonable basis for requesting the physician?s note.
  • An example in the regulation illustrates that ?stacking? of reasonable alternative methods of attaining financial rewards may be necessary.? For instance if the wellness goal is reducing body mass index (BMI) to 26 or lower, a reasonable alternative method of attaining the same reward may be a program of walking 150 minutes a week.? An employee who cannot walk that much for health reasons could still attain the same financial reward by following recommendations set by his or her own physician.?
  • Finally, the preamble to the new regulations indicates that employers may not stop offering a reasonable alternative method simply because employees fail to attain the alternative goal, particularly where addictive behavior is involved.? Noting (as did the prior wellness regulations) the ?cycle of failure and renewed effort? that addicts experience, the preamble states that employers must continue to offer the alternative standard despite a low success rate, or must offer a new reasonable alternative standard such as a different weight loss program or nicotine replacement therapy.??

Developing Issues

The Agencies invited public comments on a number of topics that are on their radar screens but not yet defined enough to regulate, including the following:

  • How to apportion financial rewards among family members where the health goal may not be applicable to all of them (for instance smoking cessation).
  • How best to define ?tobacco use? (comments on this topic actually are requested in the guaranteed availability/premium rating regulations issued by HHS).?
  • How the percentage limits apply to a financial reward whose amount may not be known initially (such as waiver of copayments, which will vary depending on the employee?s health during the course of the plan year).
  • Whether evidence- or practice-based standards are needed to ensure that wellness programs are reasonably designed to promote health or prevent disease, and best practices regarding use of these strategies.
  • Other suggestions for avoiding a ?one size fits all? wellness program design.

Limited as they are to results-based programs, the regulations are not of pressing importance to employers and advisors who work with ?participation-only? wellness programs, under which no health-related goal or result must be achieved in order to receive the financial reward. ?To comply with HIPAA, these plans must only offer participation to all ?similarly situated individuals,? with differences permitted among ?bona fide employment-based classifications? such as work location, union versus non-union, etc.? (The ?similarly situated? rule equally applies to results-based programs.)? Surveys cited in the preamble to the regulations indicate that participation-only programs comprise the vast majority of wellness programs, with the most prevalent design offering a three to 11% premium discount or other cash reward to employees who complete a health risk assessment.? However, the trend towards results-based wellness programs ? particularly those for smoking cessation ? likely will increase in tandem with rising premium costs for group HMO, PPO and even high-deductible insurance policies.? This trend is anticipated to continue through implementation in 2014 of the state exchanges, the individual mandate, and the employer shared responsibility rules (pay or play) under the ACA.? For that reason, employers and benefits advisors cannot afford to ignore rules governing results-based wellness programs.??


[1] The five criteria are:? (a) that employees be able to qualify for the reward at least annually; (b) that the financial reward not exceed the percentage thresholds outlined above, as applied to the total premium cost for individual coverage; (c) that the wellness program be reasonably designed to promote health or prevent disease; (d) that the wellness program be made available to all similarly situated individuals, including that a waiver of the health goal or a reasonable alternative means of attaining the health goal be offered to employees whose health factors present an obstacle; and (e) that all written plan materials disclose the availability of other means of qualifying for the reward.? These criteria are found in the 2006 HIPAA final regulations as well as in Section 2705(j) of the Public Health Service Act, which was incorporated into the Affordable Care Act (ACA ? 1201(4)).

[2] The HHS proposed regulations would permit the tobacco use surcharge in the small group market only in connection with a wellness program that meets HIPAA nondiscrimination standards.

Ranbaxy recalls generic Lipitor in United States

MUMBAI (Reuters) - Indian drugmaker Ranbaxy Laboratories Ltd has recalled its generic version of Pfizer Inc's cholesterol-lowering drug Lipitor in the United States after certain batches were found to contain glass particles.

Ranbaxy's U.S. subsidiary, Ranbaxy Pharmaceuticals Inc, said the recall affects certain lots of 10-, 20- and 40-milligram doses of the drug, known generically as atorvastatin calcium. The 80-milligram dosage is not affected.

The company is conducting an investigation which it expects will take two weeks. It did not report any injuries connected to the tainted pills and did not say how the problem was discovered.

The recall could cause shortages of the drug in the United States, analysts said. Ranbaxy, the first company to introduce generic Lipitor after Pfizer's patent expired in November 2011, controls about 60 percent of the market, according Ross Muken, an analyst at ISI Group LLC.

"Given its dominant share of this high-volume drug, we are certain to see supply shortages over the next two weeks," Muken said. The near-term impact is likely to be felt most by retail pharmacies and more modestly by wholesalers, he added.

The recall is the latest in a series of manufacturing problems at Ranbaxy, which is operating under heightened scrutiny following a long-running dispute with the U.S. Food and Drug Administration.

In 2008 the FDA banned the company from importing about 30 drugs after it found manufacturing deficiencies at two of the company's facilities in India. In 2009 the U.S. government accused Ranbaxy of falsifying data used in drug applications.

Last December, Ranbaxy agreed to make changes to its manufacturing plants in the United States and India. And it said it would set aside $500 million to resolve any potential civil or criminal charges stemming from an investigation by the U.S. Department of Justice.

Under a proposed settlement earlier this year, Ranbaxy agreed to engage a third party to conduct a review of its facilities, implement procedures to ensure data integrity in its marketing applications, and ensure it meets good manufacturing practices.

During its first six months on the market, when it enjoyed marketing exclusivity, atorvastatin generated sales of nearly $600 million for Ranbaxy, according to Bhagwan Singh Chaudhary, a research associate at the brokerage IndiaNivesh.

"The (recall) will impact the company's credibility," said Chaudhary. "A recall suggests corrective measures suggested by the U.S. FDA are not being implemented."

Other drugmakers, including Indian rival Dr. Reddy's Laboratories Ltd, have launched their own versions of Lipitor, and the market has become more competitive.

In 2008, Japan's Daiichi Sankyo Co acquired a majority stake in Ranbaxy in a deal valued at $4.2 billion.

Shares of Ranbaxy, which is valued at $3.93 billion, fell 3.3 pct to 496 rupees in Mumbai.
